Credit Card Surcharges in New York: The Posting Rule

Filed by @travisunks893

Can a New York business add a credit card surcharge?

Yes, within rules that are stricter than most owners expect. New York law requires that the price a customer sees posted is the total they will pay with a credit card — you cannot advertise a lower figure and add the card fee at the register. A surcharge also cannot exceed what your processor actually charges you for that transaction.

The rule is about disclosure far more than it is about the percentage.

What does compliant posting look like?

  • Show the credit card price as the listed price, with a lower cash price alongside if you want one.
  • Never show only the cash price and reveal the card price at checkout.
  • Cap the surcharge at your actual cost of acceptance for that card.
  • Apply it to credit only — debit and prepaid are treated differently.
  • Make the receipt show it as its own line.

How is cash discounting different?

A cash discount starts from the posted card price and takes money off for cash. A surcharge starts from a lower price and adds money for cards. They can end at the same total, and the one that satisfies the posting requirement is the one framed as a discount off the displayed price.

Will it cost you customers?

Some, and it varies sharply by trade. Quick-service and convenience tend to absorb it without much complaint. Full-service restaurants and anywhere with a considered purchase see more pushback, because the fee lands at the moment the guest is deciding how they feel about the bill.

Can the POS handle it automatically?

Most modern systems can apply it as a rule rather than a manual button, which matters because manual application is where mistakes and inconsistency creep in. Confirm it can distinguish credit from debit, since applying a surcharge to debit is the common compliance failure.

Is it worth doing at all?

If processing is costing you meaningful money every month, it is at least worth modelling. Run the numbers on your real volume before deciding, rather than on the percentage alone.

What to do next

Check how your prices are currently displayed on menus, shelf tags and your website, because that is where compliance is usually won or lost. Rules change and enforcement varies, so confirm the current position with your own counsel before switching anything on.
